New Compliance Forms Now Available
Apartment Association California Southern Cities (AACSC) is pleased to introduce several new and updated forms reflecting recent legislative changes, including California Assembly Bill 628, California Assembly Bill 414, and California Assembly Bill 1529. These forms are intended to help property owners and managers meet new legal requirements, properly document tenant agreements and notices, and reduce the risk of disputes by maintaining clear written records. We encourage members to review the updates and begin using the applicable forms in their rental agreements and related transactions.
AB 1529 Update: Tenant Protection Act Notice Requirement
Pursuant to California Assembly Bill 1529, which impacts notice requirements under the Tenant Protection Act of 2019, AACSC has updated form F11 - Standard Residential Agreement to include the required “Exemption and Subject Notice” language. This notice is now attached as an additional form to the rental agreement. Providing the correct notice remains essential, particularly for owners claiming exemption from AB 1482, and members should begin using the updated form for all new leases and applicable renewals.
F43A - Appliance Provision Election Notice (Lease Amendment)
Under California Assembly Bill 628, landlords must provide a refrigerator and stove in residential units unless the tenant legally opts to supply their own. We previously released Form F43 – Tenant and Landlord Appliance Addendum to document whether the landlord or tenant will provide these appliances as required by law. The newly uploaded form F43A – Appliance Provision Election Notice (Lease Amendment) is a tenant notice used when a rental agreement is amended and the obligation to provide a refrigerator and stove becomes effective. This notice informs the tenant of the requirement and confirms whether the tenant will furnish their own refrigerator or whether the landlord will provide one. Members should use this form in conjunction with amended rental agreements to ensure compliance with AB 628.
F80A – Security Deposit Return and Distribution Agreement
Per California Assembly Bill 414 (AB414), tenants may now mutually agree on how the security deposit will be divided and the method by which each tenant’s portion is returned (e.g., by mail or electronic transfer). To support this, we’ve added form F80A - Security Deposit Return and Distribution Agreement to our forms library. This form documents the tenants’ agreed-upon allocation and return method. This form helps landlords and property managers streamline compliance with AB 414 and avoid disputes by clearly recording each tenant’s consent and preferred return method at the end of the tenancy.
F80B – Security Deposit Return and Itemized Statement Delivery Authorization
In addition to the Security Deposit Return and Distribution Agreement, California Assembly Bill 414 also allows landlords and tenants to mutually agree on how the required itemized security deposit statement will be delivered. Our new Form F80B – Security Deposit Return and Itemized Statement Delivery Authorization documents the parties’ agreement to receive the itemized statement either by email or by first-class mail. Using this form helps clearly establish delivery preferences and maintain compliance with AB 414 requirements.
